Small businesses asked the Supreme Court on Tuesday to take up the issue of whether President Donald Trump’s “Liberation Day” tariffs are lawful, marking the first time the president’s sweeping tariffs have made it to the high court, and teeing up a potential final ruling on whether the tariffs are lawful by the end of the year.

An Illinois toy company is challenging Donald Trump’s tariffs at the Supreme Court. Learning Resources Inc. filed an appeal asking the Supreme Court to take up the case soon rather than let it continue to play out in lower courts.

A federal appeals court ruled Trump can continue to collect tariffs while businesses and states try to overturn taxes on foreign imports.
